Scope of this Policy:

Clean Energy, a California corporation, and its affiliated entities, parent corporation, and subsidiaries (collectively, the “Company” or “we”) has developed this Privacy Policy out of respect for the privacy of our customers, visitors to our website, job applicants, and independent contractors. This policy describes the Personal Information we collect, use, and disclose about individual consumers, applicants, and contractors who visit or interact with this website, visit any of our offices, facilities, or locations, purchase or inquire about any of our products or services, contract with us to provide services, apply for a position of employment, or otherwise interact or do business with us.

Whenever you visit our website, we will collect some information from you automatically simply by you visiting and navigating through this site, and some voluntarily when you submit information using a form on the website, enroll in or subscribe to our newsletter or marketing communications, request information, or use any of the other interactive portions of our website. Through this website, we will collect information that can identify you and/or your activity.

Additionally, whenever you communicate, interact, or do business with us, we will be collecting Personal Information from you or about you in the course of our interaction or dealings with you, whether online or at any of our physical locations or facilities, or whether you are contracted to perform services for us or apply for a position of employment.

This policy does not apply to our current and former employees and their family members, dependents, and beneficiaries where the data is collected in the employment context. This Policy provides information specific to Canada regarding your privacy. It reflects the requirements set out by the Personal Information Protection and Electronic Documents Act (PIPEDA), Alberta’s Personal Information Protection Act (PIPA), British Columbia’s Personal Information Protection Act (BC PIPA, Private Sector Act), and Quebec’s Law 25 (collectively, the “applicable laws”)

The meaning of “Personal Information” may be defined based on your province of residence: in this policy, it means any information that can reasonably be used to identify an individual.

Clean Energy is responsible for the Personal Information it collects and uses, including information shared with service providers who help us operate our business. We take protecting Personal Information seriously and have measures in place to keep it secure, including safeguards, clear processes for handling privacy questions or concerns, and employee training on privacy responsibilities.

Clean Energy collects, uses, and discloses Personal Information of visitors and website users with their knowledge and consent, as required by applicable law. Personal Information may be collected when you visit our websites, communicate with us, attend events, or otherwise interact with us online or offline.

Consent may be express or implied, depending on the sensitivity of the information and the purpose for which it is collected. Implied consent may be relied upon where the purpose is obvious or reasonably expected, such as responding to inquiries or providing requested information. Express consent will be obtained where required by law, including for sensitive information or for purposes not reasonably expected

Customers and Business Clients

In the context of commercial relationships, Clean Energy collects, uses, and discloses Personal Information relating to representatives, contacts, or authorized users of its business customers and clients as reasonably necessary to establish, manage, and administer contractual and business relationships, in accordance with applicable privacy laws.

Where permitted by law, this collection, use, and disclosure is based on the existence of a business or contractual relationship, including for purposes such as account administration, communications, service delivery, invoicing, compliance, and contract management. Consent is obtained where required by law, including where the Personal Information is sensitive or where the intended use falls outside reasonable business expectations.

Independent Contractors and Job Applicants

In accordance with applicable law, Clean Energy may collect, use, or disclose Personal Information relating to independent contractors and job applicants without consent where the information is reasonably required to establish, manage, or terminate an employment or engagement relationship, or to evaluate suitability for such a relationship. Where notice is required, this section serves as that notice.

Where Personal Information is used for purposes outside core recruitment, engagement, or management activities, such as the use of photographs or likenesses for marketing or promotional purposes, Clean Energy will obtain consent where required by law.

Québec-Specific Notice

For individuals located in Québec, Clean Energy collects, uses, and discloses Personal Information only for specific, explicit, and legitimate purposes. These purposes are communicated in clear and simple language at or before the time the Personal Information is collected, and the information is used only for identified purposes or as otherwise permitted by law.

Where consent is required under Québec law, it is obtained expressly and separately where appropriate and may be withdrawn in accordance with applicable legal requirements.

Withdrawal of Consent

Where consent is required, individuals may withdraw their consent at any time, subject to legal or contractual restrictions and reasonable notice. Withdrawal of consent may affect Clean Energy’s ability to provide services, continue a business relationship, process an application, or maintain an engagement, as applicable. Collection of Personal Information

Based on your specific transactions and interactions with us or our website, we will or may collect, and we have collected, the following categories of Personal Information about you. Internet Network and Computer Activity	Date and time of your website visit; webpages visited; links clicked on the website; browser ID; browser type; device ID; operating system; form information downloaded; domain name from which our site was accessed; search history; cookies; internet or other electronic network activity information related to usage of Company networks, servers, intranet, or shared drives, as well as Company-owned computers and electronic devices, including system and file access logs, security clearance level, browsing history, search history, and usage history.
Mobile Device Data	Information collected when you navigate, access, or use any of our websites via mobile device, including device type, software type; data identifying your device if you access our business networks and systems, including cell phone make, model, and serial number, cell phone number, and cell phone provider.
Form and other Electronic Submission Data	Data submitted through the website, including “Contact Us” forms and search bar queries.
Online Portal and Mobile App Access and Usage Information	Username and password, account history, usage history, file access logs, security clearance level, and any information submitted through the account.
Visual, Audio, or Video Recordings	Your image when recorded or captured in surveillance camera footage or pictures of you taken on our premises or at our events or that you share with us; video and audio recordings of calls and virtual meetings as disclosed to you at the time of the call.
Pre-Hire Information / Pre-Contract Information	Information gathered on job applicants and independent contractors as part of background screening, reference checks, pre-hire/contract drug test results, information gathered as part of vendor evaluation and other assessments of your qualifications to provide services to the Company, information recorded in job interview notes, information contained in candidate evaluation records and assessments, information in work product samples you provided, and voluntary disclosures by you.
Employment and Education History	Information contained in job applicants’ resumes regarding educational history, information in transcripts or records of degrees, vocational certifications obtained, and information regarding prior job experience, positions held, and when permitted by applicable law your salary history or expectations.
Professional Related Information	Information on independent contractors contained in Canadian tax forms (e.g., T4A slips), safety records, licensing and certification records, and performance records, and information related to services provided by independent contractors, including in statements of work.
Facility & Systems Access Information	Information identifying you, if you accessed our secure company facilities, systems, networks, computers, and equipment, and at what times, using keys, badges, fobs, login credentials, or other security access method.

Source of Collection

Clean Energy collects Personal Information in accordance with applicable law. The Company will collect Personal Information directly from you; however, we may also collect Personal Information from outside sources with your consent. We may collect Personal Information without consent if the law authorizes such collection, including when the collection from third person is necessary to ensure the accuracy of the information if the person is authorized to communicate such information.

We may collect your Personal Information from the following sources:

Clean Energy is committed to collecting only the Personal Information that is necessary to establish, manage, and maintain the employment relationship, and meet our legal, regulatory, and operational obligations. We may collect, use, and disclose your Personal Information for the purposes outlined below, and may share this information with third party service providers who help us with carrying out these activities:

JOB APPLICANT PURPOSES:
1. To fulfill or meet the reason you provided the information, such as assessing your candidacy for employment and communicating with you about the recruitment process.
2. To comply with federal and provincial employment laws, human rights legislation and public health orders that require employers to maintain certain records and take measures related to infectious disease outbreaks, pandemics or public health emergencies.
3. To evaluate your application, verify information (including background checks and references) and determine suitability for employment.
4. To contact you regarding your candidacy, permit you to create a profile for future applications and, if you consent, to keep your application on file for other positions.
5. To evaluate and improve our recruiting methods and strategies and to manage business relationships with vendors, service providers and contractors involved in recruiting.
6. To engage in lawful monitoring of applicant activities and communications when they are on company premises or using Clean Energy networks, devices or systems, in accordance with applicable labor and privacy laws.
7. To allow review or disclosure of applicant records under non-disclosure agreements when evaluating potential business transactions such as mergers or acquisitions.
INDEPENDENT CONTRACTOR AND BUSINESS-TO-BUSINESS PURPOSES:

To fulfill or meet the reason you provided the information, engage the services of independent contractors and administer compensation.
To comply with federal and provincial laws requiring businesses to maintain certain records (e.g., occupational health and safety records and tax reporting forms such as T4A slips required by the Canada Revenue Agency).
To evaluate, make and communicate decisions regarding independent contractors, including decisions to engage or terminate services, and to grant contractors access to secure company facilities, systems and devices.
To implement, monitor and manage security measures on contractor devices used to access company networks and systems and maintain information about who accessed such systems and what activities were performed.
To evaluate, assess and manage Clean Energy’s business relationships with vendors, service providers and contractors that provide services to Clean Energy.

Your Privacy Rights and Choices

Depending on your province of residence, Canadian privacy laws provide you with certain rights regarding your Personal Information. As these rights vary under federal and provincial legislation, Clean Energy will address privacy rights requests in accordance with the applicable law.

Right to be Informed. Individuals have the right to know why their Personal Information is being collected, how it will be used and with whom it may be shared.
Right to Access. Individuals can request access to the Personal Information that Clean Energy holds about them and to know how it is used and disclosed
Right to Correction (Rectification). Individuals can request that incomplete or inaccurate Personal Information be corrected. Clean Energy will make reasonable efforts to ensure that Personal Information is accurate, complete and up to date as necessary for the purposes for which it is used. Personal information used on an ongoing basis is assumed to be accurate unless a request for correction is received. Individuals are responsible for notifying the company of any significant changes to their Personal Information.
Right to Erasure (Right to be Forgotten). Individuals may request deletion of their Personal Information when it is no longer needed or when the organization has handled it unlawfully.
Right to Data Portability. Individuals in Quebec may request their Personal Information in a structured, commonly used technology format and may request its transfer to another organization.
Right to be Informed about Automated Decision-making. Individuals may request information about the technology used and the factors that led to the decision. Clean Energy does not rely solely on automated decision making to make hiring or engagement decisions; if that changes, individuals will be notified.

You must provide sufficient information in your request to allow us to identify the information you are seeking. We will respond to your request within 30 calendar days unless an extension is granted. We may charge a reasonable fee to provide information, but not to request correction to your Personal Information. We will advise you of any fees that may apply before beginning to process your request.

If we refuse a request in whole or in part, we will provide the reasons for the refusal. In some cases where exceptions apply to access, we may withhold that information and provide you with the remainder of the record.

Safeguards

Clean Energy protects Personal Information in our possession and control by using security safeguards appropriate to the sensitivity of the information. These safeguards are designed to protect against loss, theft, and unauthorized access, disclosure, copying, use, or modification. The Company applies these protections regardless of the format in which the information is stored. The nature and extent of the safeguards vary depending on the sensitivity, volume, and storage method of the information. A higher level of protection is applied to more sensitive categories of information.

Your Ad Choices: Interest-Based Advertising

Our website uses small pixel files and cookies to keep track of your browser so that you will be recognized when you visit other websites where our third-party ad management providers may show you advertisements from us based on your visit to our website. Notification may be delayed if required to avoid interfering with an investigation conducted by law enforcement or another authorized agency.

Clean Energy will maintain a record of all security incidents involving Personal Information and will implement reasonable measures to mitigate risk and prevent similar incidents from occurring in the future. A copy of the breach record may be provided to regulatory authorities upon request.

Challenging Compliance

Depending on your province of residence, you may challenge Clean Energy’s compliance with this Policy. Challenges must be submitted in writing to the Privacy Officer with sufficient detail to allow for appropriate investigation and response. Clean Energy will respond to such requests within 30 days of receipt or as otherwise required by law.
